Fast Track Fundings is a loan matching service — we connect consumers with participating lenders in our network ("Lender Partners"). We are not a direct lender and do not make credit decisions.
BY AGREEING TO THESE TERMS, YOU GIVE UP YOUR RIGHT TO SETTLE ANY DISPUTES WITH FAST TRACK FUNDINGS IN A COURT OF LAW OR BEFORE A JURY. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS.
Our loan referral service (the "Service") connects consumers with prospective Lender Partners participating in our network. To use the Service, you must complete an online request form (a "Request Form") that collects personal information, including your name, address, phone number, email address, Social Security Number, bank account information, and employment details.
Our collection and use of this information is governed by our Privacy Policy, which is hereby incorporated into these Terms by reference.
By submitting a Request Form, you authorize Fast Track Fundings to share your information with our Lender Partners. You also agree that Fast Track Fundings and its Lender Partners may contact you by any means — including email, telephone, SMS, or direct mail — to process your Request Form or to provide you with additional offers now or in the future.
Fast Track Fundings is not a lender and does not make loans or credit decisions. We do not guarantee that any Lender Partner will offer you a loan, or that any loan offer will contain specific terms or conditions. We do not guarantee that the rates, fees, or other loan terms offered through our Service are the best available.
Lender Partners who receive your Request Form may perform a credit check to determine eligibility. This may include:
These inquiries may be performed through TransUnion, Equifax, Experian, or alternative agencies such as Microbilt, Teletrack, DP Bureau, or DataX. By submitting your Request Form, you consent to such inquiries.
If a Lender Partner determines that your Request Form meets its underwriting criteria, your browser may be redirected to that lender's website. Once redirected, Fast Track Fundings has no further involvement in the loan application or decision process. Your interaction with that lender is subject to their own privacy policy, terms of use, and applicable agreements.
By submitting your Request Form, you agree to receive notifications, disclosures, and other communications from both Fast Track Fundings and our Lender Partners electronically. This includes:
If a Lender Partner allows you to withdraw consent to electronic disclosures, please contact that lender directly. Note that withdrawing consent may affect your ability to receive a loan.
You represent and warrant that all information you provide to Fast Track Fundings and ultimately to Lender Partners through your Request Form is accurate, complete, and truthful. Providing false or misleading information is a violation of these Terms and may constitute fraud under applicable law.
If any information in your Request Form is found to be inaccurate or untruthful, Fast Track Fundings reserves the right to deny, suspend, or terminate your access to the Service at any time, without notice.
As a condition of using this Website and the Services, you agree to indemnify, defend, and hold harmless Fast Track Fundings, its subsidiaries, affiliates, officers, directors, employees, agents, Lender Partners, and suppliers from and against any and all liabilities, losses, damages, expenses (including reasonable attorneys' fees) and claims arising from:
Any claim, dispute, or controversy arising out of or relating to the use of the Website, the use of the Services, or any acts or omissions for which you may contend Fast Track Fundings is liable (a "Dispute") shall be resolved exclusively by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA) in effect at the time of the dispute.
